Terms of Service

1. Scope

These Terms of Service govern the use of the RPCutter platform at https://rpcutter.de.

By using the platform you agree to these Terms of Service.

2. Description of service

RPCutter is an online platform for automatically creating gameplay clips from uploaded video recordings.

The features offered include in particular:

  • Sign-in via Discord
  • Uploading gameplay recordings
  • Automatic kill detection
  • Creation of individual video clips
  • Downloading the generated clips
  • Public user profiles
  • Public and private clips
  • Like function
  • Leaderboards
  • Community features

There is no entitlement to specific features or to permanent availability of the platform.

3. User account

Use requires signing in via Discord.

A user account is created automatically upon sign-in.

The user is responsible for protecting access to their Discord account.

A user may use only their own account.

4. Permitted use

RPCutter may be used solely for lawful purposes.

In particular, it is prohibited to:

  • upload malware,
  • circumvent security mechanisms,
  • carry out automated attacks against the platform,
  • overload the platform,
  • exploit technical vulnerabilities,
  • harass or threaten other users,
  • upload content whose publication violates applicable law.

5. Uploaded content

The user confirms that they hold all necessary rights to the uploaded videos.

The user bears sole responsibility for all content they upload.

RPCutter assumes no responsibility for user content.

6. Public clips

Users decide themselves whether their clips are public or private.

Public clips can be viewed and rated by other users.

The user can switch public clips back to private or delete them at any time.

7. Prohibited content

The following content may not be published or uploaded:

  • copyright-infringing content
  • criminal content
  • insulting or discriminatory content
  • content inciting hatred
  • content glorifying violence
  • terrorist or extremist content
  • pornographic content
  • content that violates the personal rights of third parties
  • content that violates applicable law

RPCutter reserves the right to remove such content at any time without prior notice.

8. Rights to the content

The user remains the owner of their uploaded content.

By uploading, the user grants RPCutter the simple, non-exclusive and revocable right to:

  • process the videos,
  • create clips,
  • display public clips on the platform,
  • generate thumbnails,
  • technically store and provide the content.

These rights serve exclusively the operation of the platform.

9. Storage and deletion

The uploaded original VOD is used solely for processing and is deleted afterwards.

The generated clips are automatically deleted no later than 30 days after creation, unless they were already removed earlier or statutory retention obligations apply.

RPCutter provides no guarantee for the permanent storage of clips.

Users are themselves responsible for downloading their clips in good time.

10. Advertising

RPCutter may display advertisements or advertising videos.

The use of individual features may be tied to viewing advertising, to the extent legally permissible.

11. Availability

RPCutter strives for the highest possible availability of the platform.

However, uninterrupted availability is not guaranteed.

Maintenance, technical faults or force majeure may lead to outages.

12. Liability

RPCutter is liable without limitation for intent and gross negligence, as well as for damage arising from injury to life, body or health.

In the case of slightly negligent breach of essential contractual obligations, liability is limited to the foreseeable damage typical for the contract.

Otherwise, liability is excluded to the extent legally permissible.

Statutory provisions, in particular under the Product Liability Act, remain unaffected.

13. Suspension of user accounts

RPCutter may temporarily suspend or permanently delete user accounts if, in particular,

  • these Terms of Service are violated,
  • unlawful content is published,
  • the platform is used abusively,
  • technical attacks are carried out,
  • automated bots or manipulation are used.

14. Changes to the platform

RPCutter reserves the right to:

  • expand features,
  • change features,
  • discontinue features,
  • adjust technical processes,

insofar as this is necessary for the operation of the platform.

15. Data protection

Information on the processing of personal data can be found in the Privacy Policy.

16. Applicable law

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods, unless mandatory statutory provisions preclude this.

17. Severability clause

Should any provision of these Terms of Service be or become wholly or partly invalid, the validity of the remaining provisions remains unaffected.

The invalid provision shall be replaced by the applicable statutory rule.
